Please read these Terms carefully before using IDCardSeva. They are a legally binding contract between you and us. By creating an account, signing in, depositing funds into your wallet, uploading any document, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not use the Service.
1. Acceptance of Terms
These Terms and Conditions ("Terms"), together with our Privacy Policy and Refund Policy, constitute the complete agreement (the "Agreement") between you ("User", "you", or "your") and IDCardSeva ("IDCardSeva", "we", "us", or "our") governing access to and use of the website at https://idcardseva.in, all related sub-domains, mobile interfaces, APIs, and any associated services (collectively, the "Service").
2. Definitions
- "Document" means any image, scan, PDF, photo, or other file containing personal-identifying information (PII), government-issued credential data, or any content uploaded to the Service by a User.
- "Output" means the rendered card, document, photo sheet, resume, or other artifact produced by the Service from User-supplied inputs.
- "Wallet" means the prepaid balance held in your account on the Service, denominated in Indian Rupees (INR), used to pay per-action fees.
- "CSC Operator" means a Common Service Centre operator acting on behalf of an end-customer who has provided informed consent.
- "Applicable Law" means any law, statute, regulation, rule, order, ordinance, or judgment of any competent governmental, judicial, or regulatory authority of India or any state therein.
- "Personal Data" shall have the meaning ascribed to it under the Digital Personal Data Protection Act, 2023 ("DPDP Act").
3. Description of Service
IDCardSeva is a software-as-a-service (SaaS) platform that uses artificial intelligence to extract structured data from User-uploaded Documents and re-render that data as professional, print-ready cards or documents. The Service is provided as a digital web application accessed through a standard web browser. No physical goods are shipped.
Supported document types currently include (but are not limited to) Aadhaar, PAN, Voter ID (E-EPIC and paper EPIC), Driving Licence, Ayushman Bharat / PMJAY, ABHA / Health ID, e-Shram, APAAR, ABC Card, UDID / Swavlamban, PPP Haryana (Family ID), Ration Card, and Farmer ID. We may add, remove, or modify supported document types at our sole discretion at any time without prior notice.
Additional design tools (ID Maker, Photo Studio, Resume Builder, Image Editor, Template Studio) are provided free of charge as ancillary creative utilities and do not perform any government-document extraction.
4. Eligibility
- You must be at least eighteen (18) years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
- By accessing or using the Service, you represent and warrant that you meet the eligibility criteria above and that all information you supply is true, accurate, current, and complete.
- If you are a CSC Operator or otherwise acting on behalf of another individual or entity, you represent and warrant that you have obtained informed, documented, and revocable consent from that individual or entity authorising you to upload, process, and render their Document(s) using the Service.
- The Service is intended for use by individuals and businesses located in India. Use from any other jurisdiction is at your own risk and you remain solely responsible for compliance with the laws of that jurisdiction.
5. Account Registration & Authentication
- Accounts are created via Google OAuth or email-OTP authentication. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
- You agree to (i) notify us immediately of any unauthorised use of your account or any other breach of security, and (ii) ensure that you exit from your account at the end of each session, particularly on shared computers.
- You shall not (i) share, sell, lend, or transfer your account; (ii) create accounts by automated means, false pretences, or using temporary/disposable email addresses; (iii) attempt to access another user's account; (iv) use bots, scripts, scrapers, or other automated tools to access the Service; or (v) circumvent any access, authentication, or rate-limiting controls.
- We reserve the absolute right to refuse account creation, suspend, or terminate any account at any time, with or without notice, for any reason we consider, in our sole discretion, to constitute a violation of these Terms or a risk to the integrity, security, or reputation of the Service.
6. Pricing & Wallet
- The Service operates on a pay-as-you-go prepaid wallet model. The current per-card processing fee for Smart Card extraction is ₹1.99 (one rupee ninety-nine paise) per successfully rendered Output. All other tools are currently provided at no charge.
- Minimum single top-up: ₹30. Maximum single top-up: ₹1,00,000. Wallet balances do not expire while your account remains in good standing.
- All amounts are stated in Indian Rupees (INR). Where applicable, Goods and Services Tax (GST) is included unless explicitly stated as exclusive.
- We may revise pricing, top-up limits, or fee structures at any time. Material changes will be communicated through in-app notice or to your registered email at least seven (7) days before becoming effective. Continued use of the Service after the effective date constitutes acceptance of the revised pricing.
- Wallet balances are non-transferable, non-assignable, and non-redeemable for cash except as expressly provided in our Refund Policy.
7. Payment Processing
Wallet top-ups are processed exclusively through licensed third-party payment gateways (currently Cashfree Payments, an RBI-licensed PA). When you initiate a top-up, you are redirected to the gateway's hosted payment page. We do not collect, process, or store your card numbers, CVV, UPI PIN, or banking credentials. Upon receipt of a successful payment confirmation from the gateway via its server-to-server webhook, your wallet is credited atomically.
If a payment is debited from your bank account but your wallet is not credited within twenty-four (24) hours, you must contact us at support.idcardseva@gmail.com with the gateway transaction reference. We will reconcile with the gateway and, if confirmed, credit your wallet. We are not liable for delays or failures caused by the payment gateway, your bank, or any intermediate party.
8. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in compliance with these Terms and all Applicable Law. You will use the Service only for Documents that:
- belong to you in your individual capacity, OR
- belong to a third party from whom you have obtained express, informed, documented, and revocable consent to upload, process, and render those Documents using the Service.
You acknowledge that the burden of obtaining, maintaining, and producing such consent rests solely and exclusively with you, and you waive any claim against us arising from your failure to obtain or maintain such consent.
9. Strictly Prohibited Uses
You shall NOT, directly or indirectly, do or attempt to do any of the following:
- Forgery, fraud, or impersonation — use the Service to create, alter, distribute, sell, or attempt to pass off any forged, altered, fake, fictitious, or counterfeit government identity document, or to impersonate any individual living or deceased.
- Identity theft or money laundering — use any Output for the purpose of opening bank accounts, obtaining credit, registering SIM cards, accessing welfare benefits, or completing any KYC procedure on behalf of any person without that person's explicit, contemporaneous, and verifiable authorisation.
- Modification of issued credentials — modify, alter, or render any Document in a manner intended to misrepresent the date of issue, validity, photograph, signature, biometric data, holder name, address, identifier number, or any other attestation made by the issuing authority.
- Unauthorised processing of others' PII — upload any Document containing the personal data of any natural person other than yourself unless you have obtained the consent referred to in Section 8 above.
- Aadhaar Act violations — use the Service in any manner that contravenes the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 or any rule, regulation, or notification issued thereunder, including but not limited to unauthorised collection, retention, sharing, or display of full Aadhaar numbers.
- IT Act violations — engage in any conduct that constitutes an offence under the Information Technology Act, 2000 (including Sections 43, 65, 66, 66A through 66F, 67, 67A, 67B, and 72A), the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, or the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
- DPDP Act violations — process Personal Data in a manner that contravenes the Digital Personal Data Protection Act, 2023.
- Reverse engineering & competitive use — copy, decompile, reverse-engineer, disassemble, scrape, frame, mirror, resell, redistribute, or build any competing or substantially similar product or service using the Service, the Outputs, the AI prompts, the templates, or any data observed through use of the Service.
- Malicious activity — upload viruses, malware, trojans, worms, or any code designed to disrupt, damage, or limit the functioning of the Service or any third-party system; conduct denial-of-service attacks; attempt unauthorised access to any portion of the Service or related infrastructure; or interfere with any other User's use of the Service.
- Content abuse — upload Documents that are obscene, defamatory, hateful, or that infringe any third-party intellectual property right.
- Volume abuse — exceed published rate limits, create multiple accounts to circumvent limits, or use the Service for bulk processing exceeding ordinary commercial use without our prior written consent.
Violation of this Section 9 may result in (i) immediate suspension or termination of your account, (ii) forfeiture of any unused wallet balance towards reasonable damages, (iii) reporting to law enforcement and regulatory authorities (including the Cyber Crime Cell, UIDAI, the Income Tax Department, and CERT-In where applicable), and (iv) full civil and criminal recourse available to us under Applicable Law.
10. User Content & Document Authorisation
- You retain ownership of all Documents and personal data that you upload ("User Content").
- By uploading User Content, you grant IDCardSeva a worldwide, royalty-free, non-exclusive, sub-licensable licence — for the limited purpose of providing the Service to you — to ingest, process, transmit, render, store transiently, and display the User Content. This licence terminates when you delete the User Content from the Service or close your account, subject to legally mandated retention periods (e.g., transaction records).
- You represent and warrant that (i) you own or have the right to upload all User Content you submit; (ii) the User Content does not infringe any third-party right (including intellectual property, privacy, or publicity rights); (iii) you have obtained all consents required under Section 8 above; (iv) the User Content does not contain malicious code; and (v) the use of the User Content by IDCardSeva in the manner contemplated by these Terms will not violate any Applicable Law.
- We do not use User Content to train any of our AI models or any third-party AI model. Documents are passed transiently through our AI extraction partner for the sole purpose of producing the Output you requested. The current list of named sub-processors is available in our Privacy Policy and may be updated from time to time.
11. AI Extraction & Output Disclaimer
- The Service uses third-party large-language-model and computer-vision APIs to extract data from Documents. AI extraction is probabilistic. We do not warrant or guarantee that any Output is 100% accurate, complete, current, or fit for any particular purpose.
- You agree to independently verify every field on every Output against the original Document before printing, distributing, presenting to any third party, or otherwise relying on it.
- The Output is generated for personal, organisational, or operational display, printing, and reference purposes only. The Output is NOT a government-issued document, is not a valid replacement for the original document, does not carry the legal force of the original, and must not be presented to any government authority, bank, employer, or other third party as proof of identity, age, address, eligibility, or any other attested fact, unless that third party has expressly accepted such re-rendered cards.
- You are solely responsible for any consequence — civil, criminal, financial, or reputational — arising from your use of an Output, including but not limited to any incorrect extraction, missing field, formatting variance, or production of an Output that is rejected or challenged by any third party.
12. Intellectual Property
All right, title, and interest in and to the Service — including without limitation all software, source code, object code, AI prompts, AI model fine-tuning, design templates, layout coordinates, page elements, logos, brand marks (including the "IDCardSeva" word mark and the "ID" logotype), trade dress, documentation, and any other content created by us — are and shall remain the exclusive property of IDCardSeva and/or its licensors. These Terms do not grant you any right to use any of our intellectual property except as expressly authorised herein.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service in accordance with these Terms, solely for your personal use or your authorised business use as a CSC Operator. Any other use is strictly prohibited.
Government brand marks, document layouts, holograms, watermarks, and seal impressions reproduced within Outputs are the property of their respective issuing authorities and are reproduced solely as part of a re-rendered facsimile of a Document the User has uploaded. We claim no ownership of such marks.
13. Privacy & Data Protection
Our collection, use, storage, and processing of Personal Data are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the processing of your Personal Data as described therein. We act as a Data Fiduciary under the DPDP Act with respect to account-related Personal Data, and as a Data Processor for User Content processed transiently on your behalf.
14. Refunds & Cancellations
All refund and cancellation rights are governed by our Refund and Cancellation Policy. Per-card fees are deducted only when the AI extraction returns a valid Output. Wallet top-ups are non-refundable in cash except as expressly provided in the Refund Policy.
15. Service Availability & Modifications
- We aim for high availability but do not guarantee uninterrupted, error-free, or secure access to the Service. Scheduled maintenance, third-party outages (including but not limited to our cloud hosting, managed database, AI inference, payment gateway and image-analysis partners), AI provider rate limits, internet connectivity issues, and force-majeure events may cause downtime, degraded performance, or temporary feature unavailability.
- We reserve the right at any time to modify, suspend, or discontinue the Service (or any part thereof), or any feature, document type, or pricing model, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.
16. Third-Party Services & Links
The Service integrates and relies upon third-party providers in the categories of cloud hosting, managed database and authentication, AI inference, image analysis, payment gateway and other industry-standard infrastructure services. Use of those services is subject to the respective providers' terms of service and privacy policies. The current named sub-processor list is available in our Privacy Policy and may be updated from time to time. We are not responsible for, and disclaim all liability arising from, the acts, omissions, or content of any third-party provider.
17. Suspension & Termination
- We may, at our sole discretion, with or without notice, suspend or terminate your access to all or part of the Service, delete your account, or remove any User Content if (i) you violate these Terms or any Applicable Law; (ii) we receive a credible complaint or court order; (iii) your conduct exposes us to legal, financial, or reputational risk; or (iv) we cease operations of the Service.
- Upon termination, the licences granted to you under these Terms will immediately cease, you must stop all use of the Service, and any unused wallet balance will be forfeited unless the termination is for our convenience or for our breach (in which case the residual balance will be refunded to your original payment method, subject to gateway charges).
- Sections that by their nature should survive termination shall survive (including without limitation Sections 9, 11, 12, 18, 19, 20, 21, 26, and 27).
18. Disclaimer of Warranties
THE SERVICE AND ALL OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. To the maximum extent permitted by Applicable Law, IDCardSeva, its affiliates, officers, employees, agents, partners, and licensors expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currentness, quiet enjoyment, title, system integration, or that the Service will be error-free, uninterrupted, secure, or free of viruses or harmful components.
No advice or information, whether oral or written, obtained from IDCardSeva or through the Service shall create any warranty not expressly stated in these Terms.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IDCARDSEVA, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE for any (i) indirect, incidental, special, exemplary, consequential, or punitive damages; (ii) loss of profits, revenue, business, goodwill, data, or use; (iii) procurement of substitute goods or services; or (iv) damages of any kind arising out of or in connection with the Service, an Output, the inability to access or use the Service, any conduct or content of any third party on the Service, unauthorised access, use, or alteration of your transmissions or content, or any other matter relating to the Service — whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
OUR AGGREGATE LIABILITY for all claims arising out of or relating to these Terms or the Service, regardless of the form of action, shall not exceed the lesser of (a) the total fees actually paid by you to IDCardSeva during the three (3) months immediately preceding the event giving rise to the claim, or (b) ₹5,000 (Indian Rupees Five Thousand). The existence of multiple claims will not enlarge this limit.
The limitations in this Section 19 are a fundamental basis of the bargain between you and us, and apply notwithstanding the failure of any limited remedy of its essential purpose.
20. Indemnification
You agree to defend, indemnify, and hold harmless IDCardSeva, its founders, affiliates, officers, directors, employees, contractors, agents, partners, and licensors from and against any and all claims, demands, suits, proceedings, losses, liabilities, damages, judgments, awards, interest, fines, penalties, costs, and expenses (including reasonable legal fees and disbursements) arising out of or in any way connected with:
- your access to, use of, or misuse of the Service or any Output;
- any User Content you upload, including any allegation that the User Content infringes any third-party right or that you lacked the consent or authority to upload it;
- your breach or alleged breach of these Terms or any representation or warranty made herein;
- your violation of any Applicable Law or any third-party right (including without limitation any right of privacy, publicity, or intellectual property);
- any dispute between you and a third party arising from your use of the Service; and
- any tax, duty, levy, or assessment imposed by any governmental authority on the transactions contemplated by these Terms (other than taxes on our net income).
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with us in asserting any available defences. You shall not settle any matter without our prior written consent.
21. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms to the extent such failure or delay results from any cause beyond our reasonable control, including without limitation acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government action, regulatory change, internet or telecommunications outage, power failure, denial-of-service attack, cyber-attack, third-party service outage, fire, flood, earthquake, strike, labour shortage, or unavailability of supplies.
22. Compliance with Indian Law & Intermediary Status
- IDCardSeva acts as an "intermediary" within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, and complies with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We rely on the safe-harbour protections of Section 79 of the IT Act with respect to User Content.
- You agree to comply with all Applicable Law in your use of the Service, including without limitation the Aadhaar Act, 2016, the IT Act, 2000 and rules thereunder, the DPDP Act, 2023, the Indian Penal Code, 1860 (and the Bharatiya Nyaya Sanhita, 2023, where applicable), the Indian Contract Act, 1872, and the Consumer Protection Act, 2019.
- For the purposes of Rule 3(2) of the Intermediary Rules, our Grievance Officer can be contacted at support.idcardseva@gmail.com. Grievances will be acknowledged within twenty-four (24) hours and resolved within fifteen (15) days.
23. Notices
We may give notice to you (i) by posting it on the Service, (ii) by email to your registered email address, or (iii) by SMS or WhatsApp to your registered mobile number. Any such notice shall be deemed to have been given on the date of dispatch (for email/SMS) or the date of posting (for in-app notice). You may give notice to us at support.idcardseva@gmail.com.
24. Modifications to These Terms
We may modify these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via in-app notice or to your registered email at least seven (7) days before becoming effective. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to stop using the Service and close your account.
25. Severability, Waiver & Entire Agreement
- Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
- Waiver. No failure or delay by us to exercise any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy. A waiver of any breach shall not constitute a waiver of any subsequent breach.
- Entire Agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us with respect to the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether oral or written.
- Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms (in whole or in part) at any time without notice.
- No third-party beneficiaries. These Terms do not confer any rights on any person or party other than you and us.
- Class action waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action, to the extent permitted by Applicable Law.
26. Governing Law, Jurisdiction & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.
Pre-dispute resolution. Before commencing any formal legal proceedings, you agree to first send a written notice describing the dispute to support.idcardseva@gmail.com and to negotiate in good faith for at least thirty (30) days to resolve the dispute amicably.
Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that is not resolved amicably within the thirty-day period shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties (or, failing agreement, appointed in accordance with the Act). The seat and venue of arbitration shall be Gurugram, Haryana, India. The language of arbitration shall be English. The arbitral award shall be final and binding. Notwithstanding the foregoing, either party may seek interim or injunctive relief from any competent court to protect its intellectual property or confidential information.
Jurisdiction. Subject to the arbitration clause above, the courts of Gurugram, Haryana, India shall have exclusive jurisdiction over any matter arising out of or in connection with these Terms.
